eTournament Fishing, LLC ("eTournament Fishing," "we," "us," or "our") provides a mobile application (the "App") that allows tournament organizers to electronically setup, manage and operate fishing tournaments, and allows anglers to register for and participate in tournaments by submitting fish entry information such as photos and videos for review and approval by tournament organizers.

This Privacy Policy explains how we collect, use, and disclose information we collect through the App, including personal information of our users. We encourage you to read this Privacy Policy carefully before using the App.

Information We Collect and How We Use It

We may collect the following types of information through the App:

• Personal information, such as your name, email address, mailing address, and phone number, that you provide when you register for an account or register for a tournament.
• Information about your device, such as your device type and operating system, IP address, and mobile device identification number.
• Information about your location, such as your GPS coordinates, that is collected when you use certain features of the App, such as confirming your location for tournament participation.
• Information about your use of the App, such as the features you use, the tournaments you register for, and the fish entries you submit including photos and video.

We use the information we collect through the App for the following purposes:

• To provide and improve the App and its features, including to personalize your experience, to better understand your needs and interests, and to help us develop new features and services.
• To communicate with you, such as to send you updates about the tournaments you have registered for, to respond to your inquiries and support requests, and to send you promotional messages and offers.
• To enforce our terms of service and other policies, such as to prevent cheating in tournaments and to ensure compliance with rules as outlined in our policies and those as provided by tournament organizers for events.
• To comply with legal obligations, such as to respond to court orders and legal process, to comply with applicable laws and regulations, and to cooperate with law enforcement and regulatory authorities.

Information Sharing and Disclosure

We do not share or disclose personal information we collect through the App with third parties, except as described in this Privacy Policy or as required by law.

Specifically, we may share information with:

• Service Providers: These are companies that help us operate the App and provide our services, such as analytics and hosting providers.
• Tournament Organizers: By using the App and registering for events, you authorize us to share your personal information with the relevant tournament organizer.
• Business Transaction Parties: In the event of a merger, acquisition, or sale/transfer of our business or assets, we may share information with the involved third parties.
• Legal Authorities: We will disclose information to comply with legal obligations, including responding to court orders, legal processes, applicable laws and regulations, and cooperating with law enforcement and regulatory authorities.

Additionally:

• Subscription Users (Peer-to-Peer Sharing): Subscription users may share content with each other through peer-to-peer functionality within the App. This sharing is governed by the App's functionality and in accordance with terms and conditions.
• App Subscriber Profile Visibility: We allow App subscribers to view limited profile information of other subscribers. The specific information visible is determined by the App's design and user privacy controls.

Data Retention and Security

We keep the personal information we collect through the App only as long as we need it to provide our services, meet legal requirements, resolve disputes, and enforce our agreements. We use reasonable security measures to protect this information against loss, misuse, unauthorized access, disclosure, alteration, and destruction. However, no security system is foolproof, and we cannot guarantee absolute security.

We do not endorse any third-party products, services, or opinions that may be mentioned or linked to in the App. We make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability with respect to the services or information contained in the App or the functionality services provided through the App. The App and its content are provided “as is” and “as available”, without any warranties of any kind, and We do not guarantee that the App will be uninterrupted or error-free. By using the App, you agree to this disclaimer and understand that you use the App at your own risk.

5. Utah Consumer Privacy Act (UCPA):

   o The UCPA grants you rights to control your personal data.

   o We safeguard your information, accept consumer requests, and comply with data protection assessments.

Children Under 13

We do not permit children under the age of 13 to use our app. If a child is registered for an event by their parent or legal guardian, it is the sole responsibility of the parent or legal guardian to request that we delete such profile information.   Such requests must be provided in writing.

Limitation of Liability

To the fullest extent permitted by law, We shall not be liable for any damages, losses, or expenses arising from the use of the App or the information contained herein. This limitation of liability applies regardless of the form of action, whether based on contract, tort, strict liability, or otherwise. We do not guarantee the accuracy or completeness of the information contained in the App, and will not be liable for any errors, omissions, or inaccuracies. The App may contain links to third-party websites, and We are not responsible for the privacy practices or content of these websites. By using the App, you agree to these limitations of liability and release eTournament Fishing from any liability arising from the use of the App or the information contained herein.

Indemnification 

By downloading and using the mobile application, you agree to indemnify and hold harmless the company, its affiliates, its employees, its officers, directors, and its successors from any and all claims, damages, losses, and expenses arising from or related to your use of the application, including but not limited to any third-party claims for infringement of intellectual property rights.

Changes to Our Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to our practices or applicable laws. The most current version of the Privacy Policy will govern our use of your information and will always be available on our mobile app.
